Factory Polaris/Rath/Duro Rider Daryl Rath spent the weekend collecting wins on the Sportsman 850 XP

The winning weekend was started Saturday, Aug 1, at the OMA National being held at the legendary Millville MX track, in Minnesota.

The Millville track is well known for hosting the Outdoor Bike Nationals but was perfect for a little cross country action as well. Taking the opportunity of summer break from the GNCC’s Polaris and Rath are busy getting some additional testing and development done on their race bikes.

Taking the win, along with placing sixth overall in the morning class, left Rath ready for Sunday. “I think this is the best the bike has felt all season, we have dug in hard to put together a winning program and that effort is starting to show with the results.” said Rath.

The winning didn’t stop there! Saturday night, the team made the trip to Decatur, IA, for Round 5 of the IATVHSS race held on Sunday. “The IATVHSS Series is one I really enjoy racing. The people, the tracks and the rider turnout is hard to beat. I have been wanting a win there for quite some time and it was a great feeling to put the Sportsman XP back on the podium,” said Rath.

“Rath Racing has been instrumental in the success of the Sportsman 850 XP in its inaugural year on the race circuits,” said Eric Nault, Polaris race team manager. “Polaris appreciates the time and effort the team has invested in preparing and dialing in the quad and is excited for the second half of the racing season.”

Wimmer Moves Toward Championship

Wimmer Moves Toward Championship after Capturing RedBud Round of the AMA Pro ATV MX Series

Rockstar Makita Suzuki’s Dustin Wimmer took what looked like an effortless win as he sailed to his sixth win of the year, in a methodical 1-1 win at RedBud MX in Buchanan, MI.

Wimmer has run the gamut of luck this season, starting off exceptionally well, then sitting out two races with an injury, struggling trying to mount a comeback, and then winning the last two races back.

Now, Wimmer stands close to winning back-to-back championships in the ITP Tires/Moose Racing AMA ATV Motocross Championship Presented by Parts Unlimited, this one his toughest yet.

Monster Energy Kawasaki’s Josh Creamer and Chad Wienen were close behind, keeping the Kawasaki versus Suzuki fight alive for in the Manufacturer’s Cup Championship.

In moto one, Creamer took the MotorcycleUSA.com holeshot and led the first five laps while Harold Goodman, Wimmer and Doug Gust stayed close behind. Wienen had a rough start, starting back in ninth but in typical Wienen fashion, recovered to fourth place by the end of the moto. Wimmer passed Goodman on the 2nd lap and pressured Creamer until the 6th lap, when he took the lead for the win. Gust took a solid 3rd place. Honda’s Joe Byrd crashed in the first turn and finished 13th, but bounced back in the second moto.

In that moto, Goodman continued to ride well, taking the MotorcycleUSA.com holeshot while Wimmer, Creamer, Byrd and Gust followed behind. Wienen had another bad start in 9th place before he was able to recover. Wimmer passed Goodman on the second lap and took the lead, but his win wasn’t easy. Byrd and Creamer pressured each other as they started to gain on Wimmer. At the last minute, Wimmer was able to dig a little deeper to hold onto first. Byrd took second, while Creamer took th

Wimmer took to the podium with an escalated points lead. Creamer took second overall with teammate Wienen in third. Wimmer is now 45 points ahead in the points lead, so he needs to score just five points at the final round in two weeks, the ATV Dirt Days at Loretta Lynn Ranch. Wienen is in second in the points with Byrd only six points behind. Gust is only a few points behind Byrd in fourth.

As for the Manufacturer’s Cup, Wimmer’s win vaulted the Suzuki team further into the points lead, with 382 points. Kawasaki is still yet in second with 351 points. Kawsaki’s big competition is Team Honda with 348.

The popularity of the Rhino, and the fact that it represents a new category of off-road motorized vehicles, has made it a target for some plaintiffs’ lawyers who increasingly use the Internet, television advertisements and the news media to attract clients. As the first trial dates approach in personal injury litigation in various courts, some law firms have embarked on a misleading publicity campaign to influence potential jurors and/or the outcomes of these cases, and to solicit potential clients. Yamaha will properly deal with these cases in the courtroom based on all the relevant evidence and a fair opportunity to be heard.

Unfortunately, these law firms successfully convinced CBS News to help further their disingenuous publicity campaign, and the network aired a story on the Rhino that included inaccurate, incomplete and false information.

To begin with, CBS featured an incident involving Justin Miller, but failed to mention that Mr. Miller was driving a heavily modified Rhino. As the photo of that Rhino posted on CBS’s own website reveals and the investigating officer testified — the Rhino Miller was driving had an extended cage structure, and what looks to be a back seat bolted to the rear cargo bed. The vehicle’s owner signed a waiver for his purchase of a “Custom Rhino” stating that the vehicle has “additional third party parts and accessories not offered by the manufacturer” and releasing all claims against the dealer and “all other persons and entities” related to the purchase of the vehicle.

The CBS story also shows security camera footage of an incident involving Zach Murray, a former employee at a Yamaha dealership who is currently a plaintiff with his own pending lawsuit. In a post-incident letter to his employer, Mr. Murray wrote that he intentionally stepped out of the overturning vehicle. Although CBS was made aware of Mr. Murray’s letter, they neglected to include mention of it in their story.

In addition, Mr. Murray was not wearing a seatbelt or a helmet. He was operating the vehicle on pavement then made a sharp, high-acceleration turn, and did not stay inside the vehicle.

A more complete version of the security camera tape shows two other vehicles being driven recklessly on the same stretch of pavement where the accident occurred, suggesting that an atmosphere of horseplay existed just prior to Murray’s crash, and that the only reason for Murray to be making a sharp, high acceleration turn was to also engage in horseplay.

In a separate part of the story, CBS cites documents that discuss an early pre-prototype vehicle that had a different design than, and no relation to, the Rhino that is on the market today. Despite being told weeks ago that it would be false to imply that these documents relate to the Rhino in any way, CBS chose to include this misleading information in its report.

Yamaha was contacted for the CBS segment two months ago by Myron Levin, a freelance reporter with a long history of writing news stories that favor the plaintiffs’ bar. Yamaha provided a great deal of information to Mr. Levin, including responding to more than 40 written questions. Mr. Levin also conducted an hour-long interview with a Yamaha representative at Yamaha’s offices in California. Yamaha did not agree to an on-air interview with the reporter, Armen Keteyian, because we could not be assured that such an interview would not be selectively edited and used in misleading ways with statements taken out-of-context given the obvious plaintiffs’ slant with which the CBS producers were developing their story.

Like the CPSC, Yamaha takes very seriously any reported Rhino-related accident, and Yamaha has fully cooperated in the agency’s investigation of the Rhino and its request for modifications. Yamaha will continue to work to promote safe and responsible use of the vehicles, including the active, ongoing development of standards for all recreational off-road side-by-side vehicles, including the Rhino.

Yamaha stands firmly behind the Rhino and will continue to vigorously defend the product against baseless claims and distortions, whether they be from plaintiffs’ law firms or biased, inaccurate media reports parroting these lawyers’ claims. The Rhino is a safe and useful off-road vehicle when driven responsibly by licensed operators aged 16 or older and according to the instructions and warnings in our on-product labels, owner’s manuals, and other safety materials.

Is CBS Interested in the Truth?

I think I just hit empty on my lifelong supply of tolerance for television news media.

Here’s the deal. CBS just aired an “investigative” piece on the Rhino fiasco. The piece was not just poorly researched but unspeakably poorly done featuring skewed misquotes, reams of inaccuracies and, of course, sensationalized accounts of Rhino operators suffering from serious injury.

I’m old enough to remember how the “investigative” TV news program, 60 Minutes, did a similar pummeling of the 3-wheeled ATV back in the early 1980s. Sure, 3-wheelers were somewhat unstable but they were a whole lot more stable than 2-wheeled dirt bikes. The result of the ridiculous report concocted by 60 Minutes killed an entire industry. Before you get concerned I might be defending 3-wheeled ATVs, I’m not.

Here’s what’s consistently stupid about these opportunistic TV talking heads who call themselves “journalists”: They intentionally miss the point every time! I hope you’re onto why they deliberately fabricate falsehoods and peddle them as truth over and over again. Ratings.

Make no mistake about this: A child in a wheelchair, or worse yet, a headstone on a grave generates huge ratings hay allowing networks to charge more for a 60-second toothpaste commercial. Ultimately it’s about money, not facts.

Here’s the point intentionally missed in the CBS “Investigative” Rhino report. It’s the same point missed with every attack on our sport or any other form of motorized recreation: RESPONSIBLE USE!

Responsible use includes these elements. Always wear a helmet. Always use seatbelts in a SxS. Never allow children to operate any adult sized off-road vehicle. Never operate any off-road vehicle under the influence of drugs or alcohol. Don’t attempt stunts you are not capable of. There you have it. Not very sexy, certainly not very interesting when compared to bedside shots of maimed “victims” of “accidents”.

Sadly, when these “accidents” are reviewed the vast majority can be explained by the lack of one or all of the former elements of responsible use. Simply put, it ain’t an accident if you’re not using the vehicle responsibly – it’s a self inflicted inevitability.

Plain and simple, the Rhino is not just a safe off-road vehicle, it is an incredibly safe off-road vehicle.

A Rhino, when operated responsibly, is safer than any off-road conveyance this side of an Abram’s tank.

I would encourage responsible off-roaders of all description to band together and tune out CBS news and send the network and your local station a letter telling them why.

Get informed and get involved. This isn’t about Rhinos or SxS off-road vehicles; this is about the future of all motorized off-road recreation.

Think of it this way. If you gave those involved in unfounded, self inflicted personal injury Rhino lawsuits – the ones that are a result of irresponsible behavior – a loaded gun, do you think someone might get shot and the gun maker sued? I do.

Hatfield-McCoy Trails ‘Safest Place to Ride’

Since opening in 2000, the Hatfield-McCoy Trails has been one of the safest places in the country to ride ATVs.

Hatfield-McCoy’s safety record comes against a backdrop of a recent spate of ATV accidents, some of the fatal, in West Virginia and nationally.

There were at least two fatal accidents in West Virginia during the third week of July alone (July 20-24). Elsewhere, Nebraska has had four ATV-related fatalities and Wisconsin three just in July, with others in Minnesota, North Carolina, Texas and Virginia.

“While accidents do occur on the Trails, they are far fewer and less serious than those that occur elsewhere,” says Executive Director Jeffrey T. Lusk. “We’ve sold about 177,000 permits since we opened and should sell another 30,000 this year. Figuring an average of 15 days on the trails for each permit sold, that means we’ve had well over 2.5 million days of riding and we’ve only had four fatalities. Although that’s four too many, we are proud of our safety record and attribute it to our trail rules and law enforcement.”

Some statistics:

– More than 95 percent of crash victims are not wearing a helmet.
– One-third of crashes involve passengers.
– About 40% of crashes occur on paved streets and roads.
– 24% of the deaths involve children 16 years of age and younger, with 12% among men 65 years of age and older.
– 22% of crashes involve alcohol or drugs.

Hatfield-McCoy rules address all these issues, banning passengers except on vehicles (such as utility-type vehicles) which are designed for them, prohibiting alcohol, requiring helmets and setting age requirements for permits.

Additionally, Hatfield-McCoy has a state-trained and approved Ranger force to patrol the trails and enforce the rules.

Also, the legislation creating the trails includes provisions that allow towns to adopt special ordinances to permit ATVs and similar vehicles on city streets. Without the special ordinances, ATVs are not allowed on roads with a center line. The rules were adopted in 2004 to address West Virginia’s nation-high rate of ATV-related fatalities.

“The Hatfield-McCoy Trails are the safest place to ride in the country,” said Deputy Executive Director John Fekete.

Introducing the 700 FI Wolverine-Grizzly

To hardcore 4-wheel drive mudders, Yamaha’s Wolverine seems like an underachiever.

We’ve talked to riders who would consider buying the Wolverine but cite its soft power delivery and top end performance. Makes sense.

A lot of Yamaha’s focus is placed on the California track and dune segment and thus, sales of the YFZ 450 and Raptor Series are extremely strong.

So far, Yamaha’s super successful 2-wheel drive dirters have overshadowed the Wolvee’s market potential.

We wonder if anyone at the Big “Y” is noticing the potential the Grizzly platform has to be morphed into a full-scale Wolverine style mud ride.

It would take few modifications to turn a 700 fuel injected Grizzly into a hardcore competitor to Can-Am’s Renegade.

Think about a Wolverine with all the 4×4 goodies the lightweight Grizzly offers – electric selectable 4WD and diff-lock, high/low range and independent rear suspension.

Throw in a bit of the horsepower from the Raptor and ditch the Wolverine’s oversized bush bar in place of a lighter grab bar. Plus, maybe beef up the front suspension with say; the YFZ’s kashima coated piggybacks. Add a slight restyling of the plastic fenders and this package would really start the drool running with serious trail enthusiasts.

Couldn’t you just see the GYTR engineers’ heads spinning with ultra-cool aftermarket accessories for a 700 FI Wolverine, too?

How about a trail specific performance exhaust that meets US Forest decibel levels or a killer big-bore kit to hammer out even more ponies, performance clutch kits, steel braided brake cables… the possibilities are endless.

Considering the fleet Yamaha already has in its stable, with a bit of attention, the Wolverine- Grizzly could make for a serious trail performer.

Yamaha’s Whitetail Diaries to Debut on Versus

Goodman Dominates Pine Lake

Harold “Bumblebee” Goodman is now “Four for Four” in the Pro Lites Class of the 2009 AMA / ATVA Extreme Dirt Track National ATV Racing Series and just shy of that (three out of four) in the Pro Division.

The event was held at Pine Lake Track at Ashtabula, Ohio where Goodman has won races in each of the last three decades.

“The Bee” went into the weekend with the fastest heat time (by five seconds) in the Pro Class. After a restart, Harold actually managed to pull two holeshots in the main.

He was able to stay in front for the win throughout the 20-lap race in spite of having Michael Coburn on his tail. The Pro Lites class was the same story – out in front and not budging.

“My Yoshimura Honda TRX450R is working really well. The whole combination that I’ve go set up right now is giving me great starts both in motocross and dirt track,” Goodman said. “I’m feeling pretty good right now as everything is going as planned.”

The Yoshimura-equipped rider is pretty much walking away with both classes in the series, with only two rounds left to go.

He has a ten-point lead in the Pro Class and a 26 point lead in the Lites.

If he succeeds, this will be his third Extreme Dirt Track Championship in both classes.
